Kava and kanna are unrelated plants that end up on the same shelf. Kava is the root of a Pacific pepper shrub and its characteristic constituents are kavalactones, which are not alkaloids. Kanna is a small South African succulent whose characteristic constituents are mesembrine-type alkaloids. They differ in botany, in chemistry, in traditional preparation, and — most consequentially for anyone buying or selling them in the United States — in how settled their legal footing is.
This post compares them on four axes: composition, tradition, regulatory posture and format. It deliberately does not compare what they do. Effects comparisons in this category are where honest writing turns into marketing.

What kava is, botanically
Kava is Piper methysticum, a shrub in the same genus as black pepper. It is sterile and sets no viable seed, so every plant in cultivation is a clone propagated from cuttings — which is why kava is discussed in named cultivars rather than varieties.
The material used is root and rhizome, the swollen basal stem at ground level. Leaves, aerial stems and stem peelings are not kava in the traditional sense, and that distinction is not cosmetic: aerial parts contain pipermethystine, an alkaloid absent from the root, and leaf and stem material in commercial kava has featured in discussions of the plant's liver-safety record for two decades. FDA has noted that non-root plant parts and mould-derived contaminants may contribute to toxicity.
Cultivars split two ways. Noble cultivars are the ones Pacific growers selected over centuries for daily use. Tudei cultivars are faster-growing and were traditionally reserved for occasional rather than routine use; the industry now treats them as unsuitable for supplements. That distinction is a hard line in any buying specification worth the name — the same kind of line that produces the categories we have declined outright.
What kanna is, botanically
Kanna is Sceletium tortuosum, a low-growing succulent from the Karoo and Namaqualand. Current taxonomic treatment increasingly accepts Mesembryanthemum tortuosum as the correct name, with Sceletium tortuosum as a synonym — not a footnote, as you will see below. The whole above-ground plant is used, and kanna has no long cultivar-selection history: wild-harvested and cultivated material both circulate, and alkaloid content varies widely.
Composition: lactones versus alkaloids
Kava's characteristic compounds are kavalactones, a family of styryl-pyrones. Six of them — kavain, dihydrokavain, methysticin, dihydromethysticin, yangonin and desmethoxyyangonin — account for the large majority of kavalactone content in root material. They are lipophilic, which makes extraction solvent a genuine specification question rather than a detail. Kava root also contains flavokavains, a group of chalcones that appear in the toxicology literature. Kavalactones contain no basic nitrogen and are not alkaloids in any sense — a product page describing "kava alkaloids" was written by someone who has not read a monograph.
Kanna's characteristic compounds are alkaloids: mesembrine, mesembrenone, mesembrenol and mesembranol, plus minor constituents. Total alkaloid content is low. One standardised kanna ingredient is described in its supplier's own published specification as standardised to roughly 0.4% total alkaloids, with the majority of that fraction as mesembrenone and mesembrenol and a minority as mesembrine. That is the brand's characterisation of its own material, not a measurement we have made or verified.
That specification is why a generic "10:1 kanna extract" is a different article, not a cheaper version of the same thing: a concentrate with an inverted alkaloid ratio is chemically distinct from the material that was characterised. One further point, and it is a safety and labelling point rather than a benefit claim: published pharmacology describes kanna's alkaloids as active at the serotonin transporter and on monoamine oxidase A, so any kanna label should carry a clear contraindication for SSRIs, SNRIs and MAOIs. Kava has no comparable interaction of that type, though it does interact with several cytochrome P450 enzymes and P-glycoprotein.
Tradition and preparation
Kava's use is documented across the western Pacific and remains a living civic institution, with formal social protocol in Vanuatu, Fiji, Tonga and Pohnpei. The traditional method is aqueous: ground root macerated in cold water, strained through fibre, served as a suspension. No alcohol, no acetone, no methanol. FDA has drawn a contrast between that traditional aqueous preparation and organic-solvent concentrates — which is why "water-extracted" tops a sensible buying preference and acetone- or methanol-extracted concentrates are a refusal.
Kanna's documented use belongs to the San and Khoikhoi peoples, and the preparation is unusual: plant material is crushed, sealed in a container and fermented, then dried. The product is called kougoed, roughly "chew things." Fermentation is reported to shift the alkaloid ratio rather than simply preserve the material, so fermented and unfermented kanna are not interchangeable inputs.
Neither tradition is a safety argument. Long use tells you a plant has been consumed, not at what dose or with what outcomes.
Regulatory posture in the US: kava
Kava's status is the settled one of the pair. Kava is not a controlled substance under the Controlled Substances Act. FDA's Dietary Supplement Ingredient Directory lists it only in the category for ingredients subject to a safety communication — the agency's long-standing liver-injury advisory — not as excluded from the dietary ingredient definition, not as failing the federal safety standard, and not as an unnotified new dietary ingredient. No state bans it.
The risk sits in the product category, not the plant. FDA's position is that kava used in conventional foods and beverages is an unapproved food additive. That position has been litigated rather than settled, including on the narrow question of whether steeping kava root in water changes the analysis, and an operator should treat the outcome as open rather than decided.
The practical consequence fits in one sentence: sealed prepackaged dietary supplement with a Supplement Facts panel, never a ready-to-drink shot, soda or seltzer. That line — supplement yes, beverage no — is where essentially all kava enforcement has landed.
Two house rules follow. The American Herbal Products Association liver-caution text goes on the label and product page verbatim — not federally mandated, and anyone claiming a federal kava liver warning requirement is wrong, but it is the documented standard of care, and we treat it as mandatory on anything we carry. And no kava-plus-kratom combination products, ever; they exist, they have drawn FDA warning letters, and one would destroy the kratom-free promise this business is built on — the reason we track the federal 7-OH scheduling action as closely as we do.
A caution on research: the widely circulated "Florida kava requirements" — a milligram cap on kavalactones per serving, a state compliance seal, a state registration scheme — do not appear anywhere in Florida law, and the statute section usually cited for them governs something else entirely. Treat vendor state-law guides as marketing until you have read the statute yourself.
Regulatory posture in the US: kanna
Kanna is the harder case, and the problem is not safety. It is not federally scheduled, and it is absent from FDA's Ingredient Directory, from import alerts, and from the Department of Defense prohibited-ingredient list. The published human safety record is better than most of this category: small controlled trials at low daily doses over periods of weeks to months, without an adverse-event signal that would stop a buyer, and no herb-drug interaction case reports on record.
The open question is legal basis. A botanical is generally a lawful dietary ingredient either because it was marketed in the United States before the statutory cutoff of 15 October 1994, or because a new dietary ingredient notification was filed and FDA did not object. No pre-cutoff kanna marketing evidence has been established, and across FDA's entire published notification list there is exactly one kanna filing. FDA has never posted its response letter, and published accounts contradict one another — the ingredient's commercial materials describe the process as completed, while trade press has described the notification as unsuccessful, with the ingredient entering the market on self-affirmed GRAS instead.
Both cannot be true. That letter is the buy gate. We are not going to stock kanna on the strength of a press release, and we would rather say so in public than pretend the question is closed.
A state-law wrinkle follows from the taxonomy note above. Louisiana's hallucinogenic-plant statute lists Mesembryanthemum species, so kanna is very likely captured, and the exposure is felony-level. The statute does exempt a dosage form labelled as a dietary supplement and manufactured under FDA's dietary supplement good manufacturing practice regulations by an FDA-registered food facility with serious adverse event reporting in place — but that exemption has to be documented in writing, per brand, before anything ships. Read the statutory text itself rather than a summary of it.
Is either plant named in the DEA scheduling action?
No. The two Notices of Intent DEA published in the Federal Register on 6 July 2026 — FR Doc 2026-13580 and FR Doc 2026-13581 — name kratom-derived compounds: 7-hydroxymitragynine above a specified concentration or amount per article in one, and mitragynine pseudoindoxyl, MGM-15 and MGM-16 with no threshold at all in the other. Neither names Piper methysticum, Sceletium tortuosum or Uncaria tomentosa. Both use the temporary scheduling authority at 21 U.S.C. 811(h), and the placements take effect on or after 5 August 2026. Format: what each is legitimately sold as
Kava belongs in a sealed capsule, tablet or tincture with a Supplement Facts panel, made from noble-cultivar root and rhizome, extraction solvent disclosed, kavalactones stated per serving and per day. As a buying ceiling we use the limits set by Australia's medicines regulator — no more than 250 mg kavalactones per day and 125 mg per dosage unit.
Kanna belongs in an ingestible form only: capsule, tablet, powder, tea, tincture or gum. Vapes, e-liquids and nasal sprays fall outside the dietary supplement definition entirely, which reaches only products intended for ingestion. A kanna vape is not a supplement with a labelling problem; it is a product with no lawful category, and any wellness claim on it becomes a drug claim.

Is either one legal in the United States?
Neither is federally scheduled. Kava's status as a lawful dietary ingredient is settled and carries an FDA safety communication about liver injury. Kanna's is unresolved and turns on an FDA response letter that has never been published. Louisiana's hallucinogenic-plant statute also appears to capture kanna unless a dietary-supplement exemption is documented.
